RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.197 dated 23.10.2018 registered under Sections 307, 323, 148, 149 IPC and Sections 25 and 27 of the Arms Act, 1959 at Police Station Sadar Patti, District Tarn Taran.
According to the prosecution, in the evening of 16.10.2018 petitioner along with co-accused Gurchet Singh and 17 other persons attacked the complainant. Petitioner and Gurchet Singh fired from their respective pistols which hit on the backside of right knee and thigh of the complainant. Other persons gave beating to the complainant. Learned counsel for the petitioner inter alia contends that parties have compromised. Petition bearing CRM-M-10274 of 2019 has already been filed for quashing the FIR in question in which parties have been directed to record their statements before the trial Court in view of RAVINDER SINGH 2019.05.24 16:14 I attest to the accuracy and integrity of this document
-2CRM-M-9819 of 2019 alleged compromise between them. He is in custody since 04.11.2018. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner any more in jail. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.
Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail during pendency of trial, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
