ARUN MONGA, J. (ORAL) Matter was taken up for hearing on 19.01.2023, when none appeared for appellant and Registry was asked to issue notice to appellant. Needful has been done.
Office report reveals that notice issued to appellant has been received back unserved with the report that no such person is residing in village Thuha. Issuance of fresh notice will be an exercise in futility as neither fresh complete and correct address of appellant is available, nor there is any representation on his behalf. It appears that by sheer effluxion of time, since the appeal is pending for the last more than 28 years, appellant has lost interest in pursuing the appeal. In the premise, instant appeal is dismissed in default. Pending applications, if any, shall also stand disposed of.
