NACT/41/2025 titled "Amar Singh v/s Pammuwala Trading Company, Chuna Bhatti Chowk, Chhachhrauli Road through its Proprietor" under Section 138 of NI Act Seeking transfer of complaint captioned above from the court of JMIC, Panchkula to the competent Court at Bilaspur, District Yamunanagar, the petitioner had come up before this Court by filing the present petition. 2.
Counsel for the petitioner submits that both the petitioner and respondent are residents of Yamunanagar, however the cheque was presented initially in Ambala and it was dis-honoured because of insufficient funds. After some time, within the period of validity, the same cheque was presented in Panchkula by opening account there. The reason for which the cheque was presented in Panchkula is that nephew of the complainant is practising lawyer in Panchkula Court.

On a query that whether the petitioner would be willing to go for mediation to settle the matter. To this, counsel for the petitioner submits that at the first instance, mediation efforts should be made at Yamunanagar and he is not averse to settling the dispute in mediation. Given above, the present petition is disposed of. The Sessions Judge, Panchkula is requested to send the matter for mediation. In case, mediation fails, liberty reserved to file fresh petition on jurisdiction after raising the objection of jurisdiction before trial Court in accordance with law. The Mediation and Conciliation Centre is also requested to communicate the concerned Advocates through the concerned Court. All pending applications, if any also stand disposed of.
