Mr. Gurmeet Singh Saini, Advocate, for the petitioner. ***** SUDHIR MITTAL, J. (ORAL) The petitioner seeks anticipatory bail in FIR No. 10, dated 19.12.2022, registered at Police Station State Special Operations Cell, SAS Nagar, under Sections 212, 216, 120-B IPC and Section 25 of Arms Act, 1959.

According to the FIR, certain under-trials were indulging in illegal activities through their associates outside. Extortion and killings were being done and the persons committing the said acts were being given shelter.

Learned counsel for the petitioner has submitted that the petitioner is not named in the FIR. The only allegation against him is of having travelled to Madhya Pradesh to buy arms and ammunition along with one Narinder Singh @ Sajjan. This is based upon a disclosure statement suffered by said Narinder Singh @ Sajjan. Nine pistols and ammunition were allegedly purchased from Madhya Pradesh and four have already been recovered from Narinder Singh @ Sajjan. The evidence against the petitioner being weak, he deserves the concession of anticipatory bail. The submission cannot be accepted. CRM-M-11580-2023 --2-- petitioner has been named in a disclosure suffered by a co-accused, it does not mean that he has not committed the offences mentioned in the FIR. Serious allegations of terrorism have been raised which need to be thoroughly investigated in the interests of the security and integrity of the Nation. Thus, the petitioner is not entitled to any discretionary relief. The petition has no merit and is dismissed.
