* * * * Notice was issued to the appellant-Municipal Committee. In response to that notice, Mr. Tarunvir Singh Lehal, Advocate put in appearance on April 12, 2016 and sought an adjournment. It was at his request that the matter was adjourned to 11.05.2016. He did not put in appearance on May 11, 2016 and the matter was again adjourned to today. He has again not put in appearance in spite of telephonic calls.

Respondent present in person earlier stated that the property in dispute was owned by the Block Samiti and it executed a registered sale deed in his favour during the year, 2001. Respondent, consequently, submits that this appeal has been rendered infructuous and he has placed on record a copy of the sale deed executed by the Blok Samiti in his favour. In view of the stand taken by the respondent appearing in person, this appeal is dismissed having been rendered infructuous.
