ARUN MONGA, J. (ORAL) Matter was taken up for hearing on 19.01.2023, when none appeared for appellant and Registry was asked to issue notice to appellant. Needful has been done.

Office report reveals that notice issued to appellant has been received back duly served through daughter-in-law, yet none appears. Respondent is also reported to have died. Since legal heirs of appellant have not taken any steps to get themselves impleaded, it appears that they are not interested to pursue the appeal filed by their predecessor-ininterest. Be that as it may, instant appeal is dismissed for nonprosecution with liberty to file application, if legal heirs wish to do so at a later stage.
