*** ARUN MONGA, J. (ORAL) Matter was taken up for hearing on 19.01.2023 and 18.04.2023, none appeared for the parties. Being an old matter, Registry was asked to issue fresh notice to the parties. Needful has been done. Office report reveals that respondent has died. However, appellants No.2 and 3 have been served but none appears on their behalf despite service. Appellants No.4 and 5 have refused to accept notice. Appellants No.6 to 11 are not residing at the given address. Since legal heirs of deceased appellant have not taken any steps to implead themselves, it seems that by sheer effluxion of time as the appeal is pending before this Court for the past more than 28 years, they have lost interest in pursuing the same. Issuance of fresh notice to unserved appellants would also be an exercise in futility as their correct addresses are not available on record.
