The only dispute in the present case is that a decree had been passed in favour of the decree-holder/petitioner herein whereby the respondents were restrained from interfering in the usage or obstructing the common passage as well as the water channel. The prayer of the DH-petitioners was that the water channel had been obstructed as trees had been grown by the respondents.

Learned counsel for the LRs of respondent No.1, at the outset, states that no trees have been grown by them and that as per the Local Commissioner's report, only shrubs and bushes have grown naturally and they would have no objection if the same are removed. 3.
Learned counsel for the petitioners' states that the petitioners would remove the shrubs and bushes as learned counsel for the LRs of respondent No.1 has now stated that he would have no objection. YOGESH SHARMA 2025.09.23 10:42 I attest to the accuracy and authenticity of this judgment/order.

In view of the above, the present revision petition is disposed off. It is, however, made clear that in case there are any trees, the same be only removed in accordance with law.
