CORAM:

HON'BLE MR. JUSTICE INDERJIT SINGH

Present:

Mr.Jagjit Gill, Advocate for the petitioner.

Mr.B.S.Virk, Deputy Advocate General, Haryana for the respondent-State.

**** INDERJIT SINGH, J.

Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.276 dated 09.11.2016 under Sections 307, 341 read with Section 34 IPC and Section 25 of the Arms Act, registered at Police Station Sadar Sirsa, District Sirsa. Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the present petitioner is named in the FIR. He fired shot from his pistol on Parveen @ Pawan, son of the complainant, which hit on left side of his abdomen and left side of his eye. CRM No.M-16321 of 2017 -2The present petitioner is the main accused. The case is at preliminary stage. If the accused is released on bail, there is every apprehension of tampering with the evidence.

In view of the above discussion, I do not find it a fit case where petitioner is entitled to benefit of regular bail. Therefore, finding no merit in the present petition, the same is dismissed.
