Report, in compliance of order dated 09.03.2022, has since been received wherein it has been stated that only photocopy of the agreement to sell was made part of the challan and was also exhibited. It has further been stated that the agreement to sell has since been traced. Learned counsel would contend that since the application for secondary evidence was moved by the petitioner-herein only for the reason that the original agreement to sell was not traceable and now since the same has been traced, there would be no requirement for leading secondary evidence. In view thereof, he states that he wishes to withdraw the main petition i.e. CR-1591-2020.
