LISA GILL, J. (Oral) The petitioner seeks quashing of order dated 21.04.2016 whereby the petitioner has been declared a Proclaimed Offender in FIR No. 103 dated 10.07.2013 under Sections 406, 420, 494, 498, 506 IPC registered at Police Station, Sadar Kharar, District Mohali. It is submitted that the aforesaid order was passed in contravention to the settled position of law. Moreover, the petitioner had appeared before the learned trial Court on 22.05.2017 and admitted to bail pursuant to interim order dated 11.05.2017. Certified copy of order dated 22.05.2017 produced in Court today is taken on record subject to just exceptions.

Learned counsel for the petitioner further submits that the petitioner undertakes to face proceedings and appear before the learned trial Court on each and every date fixed. It is, thus prayed that this petition be allowed.

Crl. Misc. No. M-16339 of 2017 [ 2 ] Learned counsel for the State, on instructions from ASI Balbir Singh, is unable to deny that the petitioner had appeared before the learned trial Court on 22.05.2017.

Keeping in view the facts and circumstances of this case, it is considered just and expedient to allow this petition. Consequently, order dated 11.05.2017 is made absolute.
