HARPREET SINGH BRAR J. (Oral) Prayer in this petition filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is for grant of regular bail to the petitioner in FIR No.196 dated 30.07.2023 registered under Sections 21-C/29/61/85 of the NDPS Act, (Section 27-A of the NDPS Act added later on) at Police Station Jandiala, District Amritsar. Custody Certificate dated 05.03.2025, has been filed in the Court today, which is taken on record.

Learned State counsel, at the very outset, submits that the petitioner is involved in 04 more cases, registered under the NDPS Act, out of which in one of the case, Section 304 IPC has also been added besides Section 21-B of the NDPS Act as one of the person had died due to drug overdose and there are 10 prosecution witnesses, cited in the list of witnesses, who are yet to be examined, and recovery of 500 gms of Heroin was recovered from the exclusive and conscious possession of MOHD YAKUB 2025.03.06 17:51 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court at Chandigarh

CRM-M-11436-2025 the petitioner, however, learned State counsel could not controvert the fact that the petitioner is behind the bars from the last 01 years, 07 months and 4 days and the FIR (supra) has been registered on 30.07.2023.

At this stage, learned counsel for the petitioner wishes to withdraw the present petition.

Dismissed as withdrawn.

However, considering the fact that the petitioner is behind the bars from the last 01 year, 07 months and 04 days, the Senior Superintendent of Police, Amritsar (Rural), is directed to ensure that all the prosecution witnesses, who are official witnesses shall appear before the learned trial Court on the next date of hearing, for recording their depositions.

The learned trial Court is also directed to take appropriate steps to procure the presence of the prosecution witnesses and conclude the trial expeditiously preferably within a period of 06 months from the date of receipt of certified copy of this order. The Registry is directed to supply a copy of this order to learned State counsel for strict compliance.
