Learned counsel for the appellant had informed that present is not his case and intimation issued to learned counsel for the respondent was received back unserved with the report 'not found, please mention Room No. or phone No.' Notice was issued to the parties and following report was received:- "Appellant - 'unserved' as he has since died Respondent No.1 - Duly served Respondent No.2 - 'unserved' as he has since died Respondent No.3 - 'unserved' as he has since died" The matter has thereafter been listed before this Court. Legal representatives of the appellant have not come forward till date. This appeal is, accordingly, dismissed in default.
