**** RITU BAHRI, J. (Oral) Present petition is for release of petitioner on regular bail in FIR No.122 dated 25.12.2011, under Sections 364, 366-A, 376 and 120-B IPC, registered at Police Station City Fazilka. Learned counsel for the petitioner submits that father of the petitioner, namely, Vinesh Juneja, has been acquitted, vide judgment of acquittal dated 24.05.2014 (Annexure P-2), passed by the learned Additional Sessions Judge, Fazilka whereas the other family members/accused persons have been found innocent by the police. This judgment has attained finality. Moreover, the petitioner was earlier granted the concession of anticipatory bail by this Court vide order dated 17.12.2013 (Annexure P-3). Since he could not appear before the trial Court, therefore, the said petition had been withdrawn by him, vide order Naresh Kumar 2017.05.26 09:49 I attest to the accuracy and integrity of this document Chandigarh dated 13.03.2014.
CRM-M-16363-2017 -2I have heard the learned counsel for the parties and with their able assistance gone through the material available on record. The petitioner was arrested on 07.11.2016. Since then, he is in judicial custody and no useful purpose would be served to further detain him in jail. The final conclusion of trial will take a long time. In view of above facts, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of learned trial Judge/Duty Magistrate, Fazilka.
Needless to mention that, nothing observed here-in-above, would reflect, on merits in the trial of the main case, in any manner.
