(Oral) The applicant/wife has filed the present application for seeking transfer of the petition under Section 13 of Hindu Marriage Act, bearing DMC-64-2024 titled "Yadwinder Singh v/s Navjot Kaur", filed at the instance of the respondent/husband, from Family Court, Ferozepur to the court of competent jurisdiction at Tarn Taran. In pursuance of notice issued, respondent had not made appearance.
Learned counsel for the applicant heard.
It is submitted by learned counsel for the applicant that one girl child was born from the wedlock of the parties to the lis, who is in the care and custody of the applicant. TA-283-2024 initiated at her instance against the respondent. In the given circumstances, it is difficult for her to defend the divorce petition filed at the instance of the respondent/husband, from a distance of about 93 kms from her place of residence, more particularly, keeping in view the minor child, being in her care and custody.
Considering the submissions, so made by learned counsel for the respondent and also considering the fact about convenience of the wife to be taken into consideration, as per the settled law, without prejudice to the rights of the parties to be adjudicated on merits, the instant transfer application, as such, is hereby accepted and the petition
of Hindu Marriage Act, bearing DMC-64-2024 titled "Yadwinder Singh v/s Navjot Kaur", stands transferred from the Family Court, Ferozepur to the Court of competent jurisdiction at Tarn Taran. The requisite record of the aforesaid divorce petition be send by the Family Court, Ferozepur to District and Sessions Judge, Tarn Taran. Learned District and Sessions Judge, Tarn Taran, shall assign the said petition to the Family Court (Camp Court), Patti, Tarn Taran. Even, the parties are directed to appear before the Family Court (Camp Court), Patti, Tarn Taran, within a period of one month from today onwards. (ARCHANA PURI) 09.08.2024 JUDGE
