The petitioner is alleged to have inflicted a kirpan injury on the left wrist of complainant Gurmukh Singh though the assault was aimed at head. Annexure P-1 is a copy of the MLR of the petitioner, indicating that on the date of the occurrence, he received a grievous injury. He has joined the investigation. No doubt cross case has not been registered but the grievous injury on the person of the petitioner is suggestive of the fact that the petitioner either inflicted the injuries in self defence or it is a case where he exceeded self defence. He, pursuant to the interim order has already joined the investigation. The dispute is amongst the real brothers over property.
The petition is allowed and interim order dated 16.1.2015 is hereby made absolute subject to the condition that the petitioner will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation or overawe the witnesses. He will not commit the similar offence, of which he is accused of, during pendency of the trial. In case of any such eventuality, bail will be liable to be cancelled.
