* * * * Plaintiff-appellant filed a suit for declaration that he became the owner of the suit land by way of adverse possession and consequently, sought permanent injunction restraining the defendants from alienating/mortgaging in any manner the suit land. The Trial Court by judgment and decree dated October 21, 1989 dismissed the suit. Plaintiff preferred an appeal, which came to be heard and decided by the learned Additional District Judge, Ferozepur. The learned Additional District Judge also came to the conclusion that the appeal has no merit and he, consequently, dismissed the appeal. Hence, this appeal at the instance of the plaintiff.

Mr. M.S. Gill, Advocate, who filed this appeal on behalf of the appellant, did not put in appearance in spite of notices. Notice was, ultimately, sent to the sole appellant and it has now been received back 'unserved' with the report that he has since died. None has come on record as his legal representatives till date. In view of the above, the record of this appeal be consigned. Liberty is, however, granted to get it revived in case of need by moving an appropriate application.
