* * * * Ms. Inderjit Kaur W/o Sh. Sarabjit Singh, respondent No.3 appearing in person submits that Manmohan Singh, respondent No.1 and Shanti, respondent No.4 have since died. She further informs that Swaran Kaur is none else but Shanti W/o Partap, thus, respondents 4 and 5 is one and the same person and she has since died. Respondent further informs that Jagmohan Singh, the plaintiff-appellant has died about 4-5 years back, who was her husband's brother.
After going through the record, we find that the suit filed by Jagmohan Singh was dismissed by the Trial Court and the judgment & decree of the Trial Court was upheld by the First Appellate Court. Learned counsel for the appellant has not put in appearance in spite of notices and telephonic calls. Even LRs of the appellant have not been brought on record.
In this view of the matter, the record of this appeal be consigned to record with liberty to the appellant or his LRs to get it revived in case of need, by moving an appropriate application. Learned counsel for the appellant be informed of the order passed.
