This appeal has come up for hearing after a period of 33 years. 2.

The learned counsel representing the appellants submits that he has no instructions about the current status of the disputed pond. In this case, the dispute is with regard to use of pond which is located in the village. The Gram Panchayat wants to convert the pond into a fish pond for commercial purpose. Both the Courts below restrained the Gram Panchayat from doing so.

The learned counsel representing the appellants submits that despite his best efforts, he failed to contact the appellants. 4.

Keeping in view the aforesaid facts, the present appeal is dismissed for non-prosecution with liberty to the appellants to file an application for revival of the appeal.
