The petitioner has filed this second petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.220 dated 17.7.2016 registered for the offences under Sections 171, 406 and 420 IPC at Police Station Sadar Tohana (wrongly mentioned as Police Station City Ratia in the impugned order dated 8.11.2016 passed by ASJ, Fatehabad), District Fatehabad.

I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that the FIR has been registered on the statement of Sumit Kumar. He stated that he received `7,000/- in exchange of `3,500/- from one person of Brar and Brar and asked him to give more money if he wanted more double money and the complainant became greedy. On 17.7.2016, the complainant alongwith Sanjay came to Samain from Ludhiana. He contacted said Brar on his mobile number. Thereafter, the complainant along with Ajay Samain reached near the Indian Petrol Harpal Singh Parmar 2017.05.16 16:43 I attest to the accuracy and authenticity of this document Chandigarh

No.M-16475 of 2017 [2] Pump and again he rang up to Brar on mobile, upon which he told him that they were just coming and after some time a vehicle Etios Toyota white colour came opposite the Petrol Pump on Samain road in which a driver, whose colour was whitish, round face, aged about 30 years, and three other persons were sitting and the complainant sat in the said vehicle, whereas Ajay was left near Petrol Pump and all the three boys started going towards Laloda road, Samain and asked him about the money which is to be converted in double. He said that he is having an amount of `5 Lakhs with him. On this, the person, who was sitting on the back seat shown the packets of `100-100 notes and taken his money in his bag.

At the same time, a white colour i20 car came there in which 3-4 persons were sitting in a dress came down and had captured the vehicle and started saying that what they were doing. The person, who was sitting on the back side, asked the complainant to go outside the car and as soon as the complainant came out from the car, both drivers drove away their vehicles from the spot. Keeping in view the facts and circumstances of the present case and in view of the fact that the petitioner is required for custodial interrogation, I do not find it a fit case where the present petitioner is entitled to the benefit of anticipatory bail. Therefore, finding no ground to grant anticipatory bail to the petitioner, this petition is dismissed.
