Mr.Kirat Singh Sidhu,DAG Punjab Mr.Vikas Chatrath,Advocate and Mr.Deepak Kumar,Advocate for respondent no.2-Bank Jaswant Singh,J(Oral) Convict-Amar Singh is seeking grant of anticipatory bail under Section 438 Cr.PC in the pending criminal appeal No.267 of 2015 pending in the Court of learned Additional Sessions Judge, Fazilka. It is averred that the petitioner stands convicted for an offence under Section 138 of the Negotiable Instruments Act and sentenced to undergo two years' RI with fine of Rs.5000/- vide judgment of conviction and order of sentence dated 4.5.2015 passed by learned JMIC,Fazilka for dishonoured cheque of an amount of Rs.1,95,000/-. For his sole absence on 30.4.2016 his bail bonds were cancelled and NBWs issued for 9.5.2016. The reason given for nonappearance was the impression gathered during the negotiations undertaken for an amicable settlement. It was contended that the petitioner was ready and willing to deposit the cheque amount and compound the offence. CRM-M 17402/2016 Vide order dated 19.5.2016 while issuing notice of motion it was directed that in the event of surrendering before the trial court within 7 days, petitioner be released on interim bail. At the time of hearing today,learned counsel states that in compliance of the said order, petitioner surrendered before the trial court on 24.5.2016 and was released on interim bail.

Learned State counsel on instructions, as also the counsel for respondent no.2 is unable to refute the said factual position. In view of the above interim bail granted by the trial court, pursuant to the order dated 19.5.2016, is made absolute. Disposed of.
