******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to petitioners in case FIR No. 68 dated 21.03.2017 registered for offences punishable under Sections 307, 506 read with Section 34 of Indian Penal Code (for short, "IPC") at Police Station Sector 17, Chandigarh.

Notice of motion.
On asking of the court, Mr. Gautam Dutt, APP, U.T. Chandigarh, who is present in the Court accepts notice and submits that intimation by Registry informing of fixation of the petition has already been received and record of the case is available with him. As per case of prosecution, Ashwani alongwith petitioners caused injuries to Satwinder Singh by intruding his shop in Sector 22-B, Chandigarh. One of the injuries received by complainant-Satwinder Singh on the head was declared grievous and case was registered for offence punishable under Section 307 IPC. CRM-M-16496 of 2017 -2been attributed simple injury with iron pipe while petitioner no. 2-Rohit Sharma has not been attributed any injury. The role attributed to him in the FIR was that he caught hold of complainant-Satwinder Singh. Both the petitioners were arrested on 21.03.2017. Main accused-Ashwani has also been arrested.
In view of above but without expressing any opinion on merits of the case and keeping in view the fact that presentation of challan and conclusion of trial will take considerably long time, the present petition is allowed. Petitioners, namely, Navdeep Singh and Rohit Sharma are ordered to be released on regular bail on furnishing bail bond and surety bond to the satisfaction of concerned trial Court/Chief Judicial Magistrate/Duty Magistrate, subject to following terms:- (a) The petitioners shall comply with the conditions mentioned in Section 437(3) Cr.P.C.
(b) In the event of their absence on any date of hearing, the benefit of bail allowed to petitioners shall stand withdrawn. The trial Court shall be competent to cancel their bail bond and surety bond and proceed to procure their presence in accordance with law. In that eventuality petitioners shall have to apply for bail afresh. (c) They shall not leave the country without the previous permission of the Court.
