******* SURINDER GUPTA, J.(Oral) The petitioners seeks transfer of Investigation of the case pertaining to FIR No.20 and 42 dated 06.02.2015 and 15.04.2015 registered at Police Station Balongi, District SAS Nagar (Mohali) and to protect life and liberty of the petitioners.

Learned counsel for the petitioners submits that FIR No.20 dated 06.02.2015 for the offence punishable under Sections 353, 186, 295-A of Indian Penal Code (IPC-for short) has been registered on the complaint of B.D.P.O. Kharar and another FIR No.42 dated 15.04.2015 for the offence punishable under Sections 323, 354 and 506 IPC has been registered on the complaint of one Balwinder Kaur alias Winder, at Police Station Balongi, SAS Nagar. CRM-M-16488-2015 -2- 'Suvidha Kendra' under the direction of B.D.P.O. Kharar and this construction was opposed by all the villagers as this building was being constructed at a common land in violation of the instructions of Punjab Government.

I have heard learned counsel for the petitioners. The petitioners have come up with their version regarding the incident. The matter is still under investigation. No reason is made out to issue any instruction for the transfer of investigation at this stage. The present petition has no merits. Dismissed. ( SURINDER GUPTA ) May 19, 2015.
