RAJESH BHARDWAJ, J.(ORAL) Petitioner has approached this Court under Articles 226/227 of the Constitution of India praying for issuance of direction to the respondents for sanctioning the mutation in pursuance to the sale deed dated 24.09.2020, Annexure P-2, as well as mutation so entered on 09.11.2020. It has been contended by counsel for the petitioner that the petitioner has become owner of the property by way of purchase vide sale deed, dated 24.09.2020 (Annexure P-2). He submits that thereafter he approached the competent authorities for sanctioning the mutation, however, the same has not been finalised till date. He submits that he had filed representation dated 06.01.2022 (Annexure P-6), as well however, the same has not been decided till date.
Learned State counsel has placed on record short reply by way of affidavit of Himanshu Gupta, Sub-Divisional Magistrate, Dera Bassi, District SAS Nagar, Mohali, Punjab and has submitted that issue involved is MEENU 2023.07.14 11:01 I attest to the accuracy and integrity of this order/judgment
CWP-5806-2022 -2also pending consideration before the Hon'ble Supreme Court. After hearing counsel for the parties and perusing the record, it is apparent that the petitioner has filed the representation and the same is not taken into consideration till date.
Resultantly, the present petition is disposed of with a direction to respondent No.2-Deputy Commissioner-cum-Collector, SAS Nagar Mohali, to take into consideration the representation, dated 06.01.2022, Annexure P-6, and take a conscious decision thereon in accordance with law within four weeks from today.
