THE HIGH COURT FOR THE STATES OF PUNJAB AND HARYANA AT CHANDIGARH.

Cr. Misc. M 17497 of 2016 Date of decision: 18.10.2016 Rakesh Kumar Petitioner vs.

State of Punjab Respondent

Present:

Mr. Atul Lakhanpal, Sr. Advocate with Ms. Babli Kumari, Advocate.

Ms. Simsi Dhir, DAG, Haryana M.M.S.BEDI,J.

With the assistance of the learned State counsel and Inspector Sanjiv Kumar, I have gone through the police record. The petitioner while working as data operator for Smart Chip Company Private Limited, Faridkot has allegedly connived with the officials of DTO Office and other coaccused Baaj Singh and Sandeep Kumar and indulged in the act of receipt of money for issuance of illegal registration certificates/ driving licences. The perusal of the statements recorded u/s 161 Cr.P.C. indicates that the allegations pertain to April, 2014 and are uncertain and vague to some extent. It has been informed that the petitioner has joined the investigation. The culpability of the petitioner, during trial, will certainly be a debatable issue.

The petition is allowed and it is ordered that in case of arrest of the petitioner, he will be released on bail to the satisfaction of the arresting officer subject to the condition that the petitioner will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation. The petitioner will not indulge in the similar activities, of which he is accused of, during the pendency of the trial.
