JUSTICE GURVINDER SINGH GILL Present:- Mr. Ashok Kumar Khunger, Advocate for the petitioners. ***** GURVINDER SINGH GILL, J.(Oral) The petitioners have approached this Court seeking issuance of a direction to respondents No.1 to 3 not to harass the petitioners and not to call them to the police station time and again in respect of FIR No.10 dated 1.2.2020 registered at Police Station Khuian Sarwar, District Fazilka under Sections 365 and 376 of Indian Penal Code.
The learned counsel for the petitioners has submitted that the aforesaid FIR was registered against one Sahil Arora, who somehow had been in touch with petitioner No.1-Parveen Kumar, who happens to be working as a clerk to an Advocate in District Courts at Fazilka in order to seek advise and infact petitioner No.1 had advised him to move a petition for grant of anticipatory bail.
The learned counsel for the petitioners has submitted that the interaction between petitioner No.1-Parveen Kumar and Sahil Arora was PANKAJ KAKKAR 2020.03.05 17:25 I attest to the accuracy and integrity of this document
( 2 ) CRM-M-9639-2020 (O&M) strictly professional but somehow the police is now pressurizing and harassing petitioner No.1 and his son i.e. petitioner No.2 so as to disclose the whereabouts of Sahil Arora and is calling them to the police station time and again.
Having heard the learned counsel for the petitioners and while refraining from making any expression as regards veracity of averments made in the petition, the petition is disposed of with a direction to respondent No.2-Senior Superintendent of Police, Fazilka, District Fazilka to ensure that in case the petitioners are required to be associated in connection with any inquiry or any information is to be elicited from them in connection with FIR No.10 dated 1.2.2020, then a sufficient prior written notice be furnished to them before summoning them. A copy of this order be sent to respondent No.2-Senior Superintendent of Police, Fazilka, District Fazilka so as to enable him to do the needful expeditiously.
