On the last date of hearing, counsel for the appellant had submitted that he is not in touch with the appellant and notice to the appellant was ordered to be issued. Today, notice issued to the appellant has been received back unserved with the report that he has refused to accept the notice. It seems that appellant is not interested in pursuing the present remedy.

Accordingly, the present appeal stands dismissed for nonprosecution with liberty to the appellant to seek its revival, in case, any cogent cause of action survives.
