This is a civil revision petition under Article 227 of the Constitution of India for setting aside the impugned order dated 06.11.2024 (Annexure P-7) passed by the Rent Controller, Jagadhri, whereby the application filed by the petitioner for dismissal of the rent petition had been dismissed.

Learned senior counsel for the petitioner has submitted that in the present case, even the proceedings before the Rent Controller deserve to be stayed in view of Section 10 CPC.

Learned counsel for the respondents has raised an objection that the said point was never raised before the Rent Controller nor such application was filed and Section 10 CPC would have no applicability in the present case.

CR No.1155 of 2025 -2Section 10 CPC would have application in the present case but in view of the objections raised by the learned counsel for the respondents to the effect that no such application was filed nor any such plea has been taken, learned senior counsel for the petitioner seeks to withdraw the present petition with liberty to move an appropriate application before the Rent Controller in accordance with law.

Keeping in view the abovesaid facts and circumstances, the petitioner is permitted to withdraw the present petition with liberty to move an appropriate application in accordance with law. 6.

It is made clear that this Court has not opined on the merits or the maintainability or otherwise of any such application and if any such application is filed, it would be open to the parties to raise all pleas as are available to them in law and the same would be decided in accordance with law.
