Challenge is by the plaintiff-appellant to the findings of fact recorded by both Courts below in a suit filed by plaintiff-appellant for declaration. 2.

Learned counsel for the appellant on instructions from Ram Kumar s/o Hari Singh submits that the matter has since been settled between the parties and no dispute survives. He prays for withdrawal of the instant appeal. 3.

In view of the aforesaid statement, the present appeal is hereby dismissed as withdrawn with liberty to get it revived, in case, any cause of action still survives.
