(ORAL) This petition has been filed by the petitioner challenging the order dated 20.2.2016 (Annexure P-3) vide which the application filed by the petitioner under Section 311 Cr.P.C. for summoning the medical officer along with the original record, was dismissed by the trial Court. Mr. Yashveer Kharb, Advocate has put in appearance on behalf of respondent No. 3 and filed his power of attorney which is taken on record. Learned counsel for respondent No. 3 submits that this petition has become infructuous as the FIR in question has been quashed by this Court on 24.1.2019. He has tendered the order dated 24.1.2019 passed by Coordinate Bench of this Court in CRM-M-42535-2018. In view of the above, the present petition is dismissed as having been rendered infructuous.
