(Oral) The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. DMC/503/2024, titled 'Harpreet Singh v/s Amarbir Kaur', filed by the respondent-husband, pending in the Family Court, Ferozepur and she seeks transfer of the same to the Court of competent jurisdiction at Tarn Taran. Upon notice issued, the respondent did not make appearance and was proceeded against ex parte.

Counsel for the applicant heard.

At the very outset, it is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 09.01.2019, but no child was born from the said wedlock. Unfortunately, the matrimonial dispute arose between the parties. The respondent is stated to be

residing abroad. The applicant is not having any source of earning. She has got loged an FIR No.5 dated 18.01.2020 under Section 498-A and 406 IPC at Police Station Chohla Sahib, District Tarn Taran. The respondent, who is one of the accused in the said case, has not made appearance. Even, challan has been presented in the same and the case is fixed for awaiting the appearance of the respondent as well as his parents, who are also the accused in the said case. Also, it is submitted that the applicant had filed one complaint under Section 12 of Protection of Women from Domestic Violence Act, which was dismissed in default. The distance between the two places is stated to be 100 kms.

Considering the submissions made aforesaid, it is pertinent to mention the respondent, who himself residing abroad, had filed the petition for seeking divorce, through his Attorney Holder, namely, Swaran Singh, who is his father. Even, the parents of the respondent, who are the coaccused in the state case, wherein challan has been presented, have not made appearance.

Considering the aforesaid fact situation and the fact of the respondent, not having come forward to resist the transfer application as well as considering the distance between the two places, the transfer application is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. DMC/503/2024, titled 'Harpreet Singh v/s Amarbir Kaur', filed by the respondent-husband, stands transferred from the Family Court, Ferozepur, to the Court of competent jurisdiction at Tarn Taran. The requisite record of the aforesaid case be sent by the Family Court, Ferozepur, to the District and Sessions Judge, Tarn Taran.

Learned District and Sessions Judge, Tarn Taran, shall assign the said petition to the Family Court, Tarn Taran. Even, the parties are directed to appear before the Family Court, Tarn Taran, within a period of one month from today onwards.
