The petitioner has filed this second petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.149 dated 6.4.2013 registered for the offences under Sections 420, 506 and 120-B IPC at Police Station Central Faridabad, District Faridabad. I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that the first anticipatory bail petition of the present petitioner has been dismissed on merit. Earlier it was specifically held in the order dated 8.9.2016 passed by this Court that the petitioner is required for custodial interrogation. Nothing has been shown as to how the petitioner now is not required for custodial interrogation. The allegations in the FIR is that the accused induced the complainant to invest money in property and kept on saying that heavy profit would be given to Harpal Singh Parmar 2017.05.15 10:49 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-16653 of 2017 [2] him. It is the case of the prosecution that an amount of `1,15,00,000/- was given by the complainant and it was told to him that booth No.4, Sector 19 and Kothi No.144, Sector 17, Faridabad are to be purchased and the money will be invested.
Therefore, keeping in view the facts and circumstances of the present case and the fact that the petitioner is required for custodial interrogation, I do not find it a fit case where the present petitioner is entitled to the benefit of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
