Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of regular bail to the petitioner, Sukhdev Singh @ Sukha, who has been booked for having committed the offences punishable under Sections 21, 25 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985,in a case arising out of FIR No.11, dated 30.08.2014, registered at Police Station, State Special Operation Cell, Amritsar, District Amritsar. CRM-M-16607-2015 (O&M) -2Learned counsel contends that concededly nothing was recovered from the petitioner; after 40 days of the registration of the impugned FIR, name of the petitioner figured in the confessional statement of his co-accused Angrej Singh and that there is no evidence to connect the petitioner with the alleged offence.

Learned counsel for the State, on instructions from ASI Jasvir Singh of Police Station, State Special Operation Cell, Amritsar, submits that during investigation both the co-accused of the petitioner disclosed that the alleged heroin was sold by the petitioner to them for onward distribution to the clients. He further points out that after arrest of the petitioner a pistol and six live cartridges were recovered from him. He further points out that during investigation it has emerged on record that the petitioner had procured the heroin from Pakistan. In view of the totality of the facts and circumstances of the case, no ground for grant of bail to the petitioner is made out. Dismissed.
