HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.181 dated 01.12.2020 under Section 306 IPC registered at P.S Nurmahal, District Jalandhar (Rural).

FIR was lodged on the complaint of Harwinder Singh @ Billa, who stated that the deceased Stephen was his younger brother. On 30.11.2020 at about 4.00 p.m, he received information that Stephen had consumed poisonous tablet of suphas and his condition was very serious. The complainant rushed to his Well and found his brother crying. Upon being asked by the complainant as to why he had consumed Sulphas, the deceased replied that his wife Ranjana Rani @ Rajbir Kaur used to quarrel with him without any reason and being fed up from her behaviour, he had no option other than to do it. Though the deceased was rushed to the Kamal Hospital, Nakodar but he died during treatment. Upon notice, a reply by way of affidavit dated 11.05.2021 of DSP, Sub Division, Nakodar, District Jalandhar (Rural) has been filed wherein it has been stated that during investigation, it was found that the deceased had himself taken this extreme step of committing suicide due to MANOJ KUMAR 2021.09.15 17:39 I attest to the accuracy and integrity of this document

CRM-M-13639 of 2021 #2# daily disputes/quarrels with the petitioner. Said conversation has been video-graphed by relative of the deceased wherein the victim is seen blaming the petitioner. The video containing the entire conversation has been taken into possession by the police and its authenticity has been got verified from the State Cyber Crime Cell, SAS Nagar. From the report sent by the F.S.L, it has also been established that the deceased had died due to Aluminium Phosphide insecticide.

Learned counsel for the petitioner contends that as per the allegations levelled in the FIR, no offence under Section 306 IPC is attracted. The petitioner is in custody since 01.12.2020 and that the trial has not yet progressed due to covid.

Opposing the petition, learned State counsel submits that the investigation is complete and report under Section 173 Cr.P.C has been filed. Out of total 24 prosecution witnesses, none has been examined so far. Without commenting anything on the merits of the case and also bearing in mind the custody period coupled with the fact that the trial of the case is not likely to be concluded in near future, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Ranjana Rani @ Rajbir is ordered to be released on bail on her furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
