**** RAJ MOHAN SINGH, J.(Oral) Petitioners seek grant of anticipatory bail in case bearing FIR No.193 dated 16.08.2020, registered under Sections 323, 326, 341, 34 IPC (offence under Section 326 IPC added later on) at P.S. Kotwali, Kapurthala, District Kapurthala. Notice of motion was issued on 23.03.2021 and arrest of the petitioners was also stayed.

It is not in dispute that the parties have amicably resolved their differences by way of entering into the settlement. Learned counsel for the complainant admits the factum

of compromise. Co-accused Gurnam Singh and Jaswinder Singh @ Jeetu have been granted concession of anticipatory bail vide order of even date passed in CRM-M No.4725 of 2021. Though in the present case, petitioners were not directed to join the investigation, but the fact remains that the parties to the case have amicably settled their differences and co-accused Gurnam Singh and Jaswinder Singh @ Jeetu have been granted concession of anticipatory bail. In view of aforesaid factual position of the case, this petition is allowed. Petitioners are directed to appear before the SHO/Investigating Officer to join investigation on 09.09.2021 at 11.00 A.M., and in the event of their arrest, they shall be released on anticipatory bail on their furnishing bail bonds to the satisfaction of SHO/Investigating Officer subject to the following conditions as envisaged under Section 438(2) Cr.P.C:- i) that the petitioner(s) shall make himself available for interrogation before the Investigating Officer as and when required;

ii) that the petitioner(s) shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to

any police officer;

iii) that the petitioner(s) shall not leave the country, without prior permission of the Court and shall surrender his passport, if any.
