(Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.982 dated 30.09.2017 under Sections 323, 325, 342, 506 and 34 IPC and Section 25 of Arms Act, registered at Police Station Sadar, District Hisar. Petitioner is stated to have caused a lacerated wound on the head of the complainant, attracting offence under Section 325 IPC. He is stated to be in custody since 13.10.2017.

Keeping in view, period of his incarceration and the fact that trial may take long time to conclude, no useful purpose would be served by detaining the petitioner any longer. Thus, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner is directed to be released on bail to the satisfaction of the trial court. However, in case petitioner is in custody in some other case, the order shall remain inoperative till such time petitioner is released from custody in said case.
