ANIL KSHETARPAL, J(Oral) On 14.05.2018, counsel for the parties made a statement that the parties have settled the dispute and a miscellaneous application has been filed to place on record a deed of compromise, which has not been listed. Hence, Registry was directed to trace out the application and place it on the file.
Today, when the case was called for hearing, learned counsel for the parties have stated that the application filed to place on record the deed of compromise has been returned with certain objections, which have been removed. Counsel for the parties pray that the deed of compromise along with the application may be taken on record and the appeal be disposed of in terms thereof.
On the other hand, learned counsel for the respondents has pointed out that respondents no.1, 2, 4 and 5 have died and he also wishes to file an application under Order 22 Rule 4 of the Code of Civil Procedure Naresh Kumar 2018.05.31 14:19 I attest to the accuracy and integrity of this document Chandigarh
RSA No.702 of 1991 (O&M) -2for permission to bring on record the legal representatives. A copy of the application supported by an affidavit has been filed, which is taken on record. Counsel for the appellants does not have any objection.
In view thereof, legal representatives mentioned in paragraphs 2, 3 and 5 of the application are brought on record for the purpose of defending this appeal only.
Amended memorandum of the parties is taken on record. Another application has been filed in Court today for disposing the appeal in terms of the deed of compromise. The deed of compromise is signed by all the parties including the legal representatives who have been impleaded in the foregoing part of the order. The deed of compromise is also signed by learned counsel for the parties. They also admit the correctness of the aforesaid deed of compromise. The deed of compromise has been marked as Mark "C". In view thereof, the appeal is disposed of as having been compromised. The deed of compromise which has been attached shall form part of the decree.
Registry is directed to assign numbers to these miscellaneous applications.
