The present petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in FIR No.153 dated 18.05.2023 registered under Sections 307, 353, 341, 323, 294, 186, 506, 148, 149 IPC at Police Station Dera Bassi, District SAS Nagar. 2.

Learned counsel appearing for the petitioner inter alia contends that the petitioner has been falsely implicated in the present case and Section 307 IPC has been added only to aggravate the offence; whereas none of the injuries would breach the threshold of the offence under Section 307 IPC. He is not involved in any other case. The complainant is a police official and therefore, offence under Section 307 IPC has been added.

Mr. Subhash Godara, Addl. A.G., Punjab appears on advance notice for the respondent-State and on instructions from ASI Ashok Kumar submits that 10-15 persons including the petitioner were beating a man and when the police party tried to disburse the mob, they were also attacked. Having heard learned counsel for the parties and after perusing the record, this Court finds no ground to grant anticipatory bail to the petitioner. 5.
