RAJESH BHARDWAJ, J.(ORAL) Instant petition has been filed under Section 482 Cr.P.C. praying for fair and proper investigation in case FIR No.167, dated 26.04.2022, under Sections 323, 342, 506 IPC, registered at Police Station Siwani, District Bhiwani, Annexure P-4.

It has been contended by counsel for the petitioner that FIR in question was registered against respondent No.5, who is serving police officer of the Haryana Police. He submits that Investigating Agencies by every means are trying to shield the accused. Notice of motion to official respondents only. On asking of the Court, Mr.B.S.Virk, DAG, Haryana, who is present in Court, accepts notice on behalf of official respondents/State and submits, on instructions from ASI Rajesh, that after investigation cancellation report has been recommended, however, the same is yet to be filed before the Court of Illaqa Magistrate.

After hearing counsel for the parties, the present petition is MEENU 2023.03.14 17:07 I attest to the accuracy and integrity of this order/judgment

CRM-M-12243-2023 -2disposed of with a direction to the Investigating Agencies to file the cancellation report, so prepared, before the Court of competent jurisdiction within two weeks from today. The Magistrate concerned is also directed to issue notice to the complainant before deciding the cancellation report, if so filed, in accordance with law.

However, the petitioner would be at liberty to approach this Court again, if so advised.
