Prayer made in the present petition is for quashing the order dated 06.09.2004, Annexure P-5, whereby recovery was sought to be effected. 2.
The Division Bench, while issuing notice of motion on 18.09.2004, had stayed the recovery, however, while admitting the petition on 11.07.2006, directed to be heard alongwith CWP-16546-2003 titled as Darshan Lal vs. State of Punjab and others, which was allowed vide judgment dated 10.02.2010, upholding the re-fixation but the consequential recovery notice was set aside.

Learned counsel for the petitioner(s) prays for disposal of the petitions in terms of the aforesaid judgment, which learned State counsel despite best efforts, was unable to resist by distinguishing the same or citing any contrary law.
