Prayer is for grant of anticipatory bail in case FIR No.43 dated 02.02.2021 under Sections 148,149,323,379-B,427,447,506 IPC (Sections 180,217,218,166-A,201 IPC added later on) registered at P.S Sadar Kanina, District Mohindergarh.

Petitioner is accused in the abovesaid FIR. He was granted interim bail by this Court vide order dated 09.03.2021 and thereafter, he had been regularly appearing before the trial Court. However, on account of failure of the petitioner to appear before the trial Court on 18.11.2022, his bail bonds were cancelled and his presence was ordered to be secured through non-bailable warrants. Learned counsel for the petitioner states that non-appearance of the petitioner was not intentional. In fact, the petitioner was busy in panchayat election though he could not substantiate his plea before the trial Court, which has led to passing of the said order dismissing his bail. He undertakes that the petitioner is ready and willing to appear before the learned trial Court and face the trial. He shall appear before the learned trial Court on any date to be fixed by this Court. Notice of motion.

2023:PHHC:057667 CRM-M-11798 of 2023 #2# Having heard learned counsel for the parties and taking into account the of the case in hand, this petition is disposed of with the observation that the petitioner may appear before the learned trial Court on or before 17.05.2023. On his doing so, he shall be enlarged on bail by the trial Court subject to his furnishing bail bonds and surety bonds to its satisfaction. He shall also file an undertaking before the concerned Court to continue appearing as and when required apart from following all the terms and conditions fixed in this respect. This shall, however, be subject to the petitioner depositing a sum of Rs.20,000/- as costs with the Poor Patient Welfare Fund, PGIMER, Chandigarh.
