**** JASWANT SINGH, J. (ORAL) The prayer is for grant of bail to the petitioner in case FIR No. 15, dated 13.01.2015 for offences under Sections 325, 307 IPC and Section 25 of Arms Act, registered at Police Station Sadar, Ballabhgarh, District Faridabad.
As per allegations, the petitioner and the complainant are friends and had drinks together. Thereafter, the complainant-injured gave a lift to the petitioner on his motor-cycle, whereupon the petitioner is alleged to have fired from his country made pistol at the upper portion of the back of the complainant.
Learned State Counsel, on instructions from SI-Younis Khan, states that during the investigation, dispute over a money transaction between the two friends has surfaced.
It is not disputed that after the investigation, the case is at the
CRM-M No. 16700 of 2015 #2# stage of recording the evidence of the prosecution and that the petitioner is stated to be in custody since 13.01.2015.
Without commenting upon the merits of the case and keeping in view the period of incarceration of petitioner-Ajit Singh, this Court finds that he is entitled to be granted the concession of bail and as such, he is ordered to be released on bail subject to furnishing his bail/surety bonds to the satisfaction of CJM/Duty Magistrate, Faridabad. Petition stands allowed.
