The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.240 dated 8.7.2013 registered for the offences under Sections 364, 302, 201, 212, 34 and 120-B IPC at Police Station Mahesh Nagar, District Ambala.

Notice of motion to Advocate General, Haryana. Mr. Vikramjit Singh, learned Additional Advocate General, Haryana, has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned Additional Advocate General, Haryana and have gone through the record. As per the prosecution version, Gurpal Singh was kidnapped by Harpal Singh Parmar 2016.08.19 16:53 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-17689 of 2016 (O&M) [2] 11 persons including the accused and subsequently he is stated to have been killed and his body was chopped off in pieces. Further from the record, I find that 33 witnesses have already been examined out of 35 witnesses. Keeping in view the nature and gravity of the offences, I do not find it a fit case where the present petitioner is entitled to the benefit of regular bail.

Therefore, finding no merit in this petition, the same is dismissed.

However, as the petitioner has been in custody since 9.6.2013 and 33 witnesses have already been examined, therefore, the trial Court is directed to expedite the disposal of the case. The Investigating Officer/SHO of the concerned Police Station are directed to produce the remaining witnesses before the trial Court at the earliest. August 17, 2016.
