The petitioner has filed the instant writ petition under Article 226 of the Constitution of India for issuance of a writ of mandamus directing respondent No.4 to consider the claim of the petitioner for appointment on the basis of compassionate ground in conformity with the approval and recommendation made by the competent authority vide resolution No.36 dated 29.08.2022. 2.

Learned counsel for the petitioner submits that for claiming the relief, the petitioner has also submitted representation dated 20.12.2023 (Annexure P-14) which is still pending consideration with the respondents and at this stage, the petitioner would be satisfied if directions are issued to respondent No.4 to consider and decide the said representation by passing a speaking order in a time bound manner. 3.

I have heard learned counsel for the parties and have gone through the record of the case.

Without expressing any opinion on the merits of the case or the claim being made by the petitioner in the present petition, respondent No.4 is directed to consider and decide the claim made by the petitioner in the representation dated 20.12.2023 (Annexure P-14), in accordance with law, by passing a speaking order within a period of three months from the date of receipt of certified copy of this order. In case, the petitioner is found entitled, his claim be released within a period of six weeks thereafter.

The petition stands disposed of.
