The case has been called twice. However, none has appeared for the petitioner today.
This is a petition filed under Section 482 Cr.P.C. for directions to respondents to trace out accused Inderjit Singh who had been convicted in a murder case. He had come out from jail on parole in January, 2013 but did not surrender. The complainant approached the court for directions to the police to trace out the accused. The matter was being adjourned for over one and half year. On the last date of hearing it had been made clear that in case the accused was not arrested, then SSP Jalandhar (Rural) would be present in court. It had also been stated on the last date that the accused did not own any property.
Today reply has been filed by the DSP (Investigation) stating therein that Special Investigation Team was formed and Inderjit RAJ KUMAR 2015.12.23 15:36 I attest to the accuracy and integrity of this document
Singh has been arrested and lodged in Central Jail, Jalandhar on 20.12.2015.
It is indeed unfortunate that the police on its own cannot act. This petition is pending since May 2014. The State had put in appearance for the first time on 17.07.2014 and during this period they had made no efforts. Only when a harsh order was passed and personal appearance of the SSP was ordered that the accused was arrested.
It appears that some help is being rendered to the accused or inaction by the officer concerned. The matter should be brought to the notice of Director General of Police, Punjab. The petition is disposed of.
Let a copy of this order be sent to the Director General of Police, Punjab for formulating some guidelines/instructions to avoid repetition of such cases.
