******* SURINDER GUPTA, J.(Oral) Learned State counsel on instructions from ASI Balraj submits that five accused were named in case bearing FIR No. 72 dated 21.02.2007. Out of five, four accused, who were facing trial have died while one accused has been declared proclaimed offender. Even respondent no. 2 has died and no effective proceedings are taking place before the trial Court. In view of submission of learned State counsel, learned counsel for the petitioner seeks permission to withdraw the instant petition with liberty to petitioner to avail other legal remedy against accused, who is proclaimed offender, as and when need so arises.
