**** RAMESHWAR SINGH MALIK J. (ORAL) Petitioners seek pre-arrest bail in FIR No. 136 dated 30.12.2014, under Sections 379/382/506/148/149 IPC registered at Police Station Sarai Amant Khan, District Tarn Taran. Notice of motion was issued and interim protection was granted.

Learned counsel for the State, on instructions from ASI Amarjeet Singh, submits that in compliance of the order dated 25.5.2015 passed by this Court, petitioners have joined the investigation. Recovery has been effected from the petitioners. He further submits that petitioners are no more required for the purpose of any further investigation.

CRM-M-16749 of 2015 Learned counsel for the complainant vehemently contended that conduct of the petitioners disentitle them for the concession of anticipatory bail. She prays for dismissal of the present petition.

Having heard the learned counsel for the parties and after careful perusal of the record of the case this Court is of the considered opinion that in the given fact situation of the present case, petitioners have been found entitled for the concession of anticipatory bail. It is so said, because since the investigation is already complete, petitioners are no more required for custodial interrogation by the investigating agency. Further, recovery has already been effected from the petitioners.

In view of the above and without commenting anything further on the merits of the case, lest it should prejudice the rights of either of the parties, present petition is allowed and order dated 25.5.2015 passed by this Court is hereby made absolute, however, subject to the conditions envisaged under Section 438 (2) Cr.P.C. Disposed of, accordingly.
