IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH.

CRM-M-16812 of 2017 (O&M) Date of Decision: 18.07.2017 Irshad @ Gadar ....Petitioner

VERSUS

State of Haryana ....Respondent CORAM:- HON'BLE MR. JUSTICE SURINDER GUPTA

Present:

Mr. S.K. Bawa, Advocate for the petitioner.

Mr. Amrik Narwal, DAG, Haryana.

******* SURINDER GUPTA, J.(Oral) CRM-21975-2017 Application is allowed as prayed for.

CRM-M-16812-2017 The petitioner is facing trial for offences punishable under Sections 346, 364-A of Indian Penal Code and 25 of the Arms Act in a case bearing FIR No. 130 dated 08.03.2016, registered at Police Station Sector 7, Faridabad.

Learned State counsel submits that the prosecution has so far examined 7 out of 20 witnesses. Yogesh Joshi and Rakesh Batra, who were kidnapped, have been examined and both have identified the petitioner and his co-accused, who had detained and kept them in illegal custody. Keeping in view above fact, I find no reason to extend the benefit of regular bail to petitioner at this stage. The instant petition has no merit and the same is dismissed.
