**** RITU BAHRI, J. (oral) Learned counsel for the appellant has informed this Court that he has no instructions to appear in the present case as of today. The appellant has come up in appeal against the order dated 05.01.1990 passed by the Sales Tax Tribunal, Haryana (Annexure P-3) whereby, the Tribunal has dismissed the appeal filed by the appellant against the order of the appellate authority which had remanded the case back to the assessing officer to pass a fresh order as per the provision of law with respect to interest and penalty.

Since, there was no interim stay of this order passed by the Tribunal, this appeal is being disposed of with the liberty to the appellant to get it revive if any cause of action survives.
