The applicant has come up against the order of dismissal dated 15.11.2021 passed by the Judicial Magistrate Ist Class, Khanna, under Section 378(4) Cr.P.C. 2.

On the last date of hearing, this Court had directed the counsel for the applicant to serve dasti notice to the respondent-Harjinder Singh. 3.

Counsel for the applicant has handed over report of dasti service as per which the respondent-Harjinder Singh has migrated from India. 4.

Given above, the present Leave to Appeal is dismissed with liberty reserved to the applicant-appellant to file fresh as and when the applicant gets correct address of the respondent.

It is clarified that filing and disposal of the present leave to appeal shall not come in the applicant-appellant's way. Also, the period for which the present leave to appeal was pending before this Court shall not be counted for the purpose of limitation.
